Immigration
There are several types of immigration applications but the two main types of applications are Family Class and Skilled Worker. Family Class is where there is a Canadian or Canadian Permanent Resident who qualifies and is willing to sponsor someone. The other is the Skilled Worker application (part of the Economic Class) which is what most people apply as. There are some other possibilities. Below are some short descriptions that will help you see which one may be right for you.
Family Class
Canadians and Canadian Permanent Residents may sponsor their spouse, common-law partner, Conjugal Partner, dependent child, parents or grandparents. At SPOUSE/PARTNERS you will find more details and information to help you see if you qualify to sponsor or be sponsored as a spouse or partner. At PARENTS/CHILDREN you will find more details on sponsoring or being sponsored as a dependent child, parent or grant-parent. In certain rare circumstances a person may sponsor someone other than mentioned above. Economic Class
A Skilled Worker application (formerly known as an Independent application) is how most people apply. This application is done under a point system and you must prove your education, language skills, work experience, etc. For more information go to SKILLED WORKER.
Business Class is a subset of the Economic Class and includes Self-Employed, Investors and Entrepreneurs.
Self-Employed sounds good but it is limited to those who have experience in and can convince immigration that they can be self supporting in their career in athletics, the cultural field, or farming. You do not have to be an athlete or an artist, as people in related careers qualify as well. Check it out at SELF-EMPLOYED.
Investors must have business experience and significant assets as well as making an investment in Canada and meeting certain other qualifications. For more information go to INVESTOR.
Entrepreneurs must also have business experience but a lower level of assets, and must agree to meet certain conditions upon becoming a permanent resident as well as meeting certain other qualifications. For more information go to ENTREPRENEUR.
Canadian Experience Class
This is a new category that recognizes the fact that those who have studied and/or worked in Canada are usually successful in becoming economically established in Canada. For more information go to CEC.
Provincial Nominee Programs
There are a few other possibilities for some people who do not fall under one of the above. Under Canadian law both the federal government and the provinces have juristiction over immigration. Each province and territory has their own immigration program and you may qualify under a specific provincial nominee program even if you do not qualify under a federal program. Someone who has worked in Canada as a Live in Caregiver, or a person whose refugee claim has been accepted, or someone who has lived in Canada on a Temporary Resident Permit may qualify to apply for permanent residence on an in Canada application.
Humanitarian and Compassionate (H&C) grounds may be used to overcome almost anything in the law that makes a person otherwise unable to apply for any form of immigration. This is at the discretion of the immigration officer and departmental policies. H&C may be used to sponsor those who would otherwise be unable to be sponsored, or to include someone on an application that they are otherwise not eligible to be included on.
Refugee Claims
The refugee system is a whole separate part of immigration law that I do not normally deal with. You may qualify for Family Class sponsorship at some point in your refugee process and this I can help you with. You should make your Family Class application as soon as you qualify.
